Welcome to Nudge. These Terms of Use ("Terms") are a simple agreement between you and Nam Le ("we," "us"), the individual who provides the app. Please read them. By using Nudge, you agree to these Terms.

1. Acceptance

By downloading, accessing, or using Nudge, you agree to be bound by these Terms and by our Privacy Policy. If you do not agree, please do not use the app.

2. License to use the app

We grant you a personal, limited, non-exclusive, non-transferable, revocable license to use Nudge on devices you own or control, for your own personal planning. We retain all rights, title, and interest in the app and its software.

3. Acceptable use

You agree not to:

  • Use the app for any unlawful purpose or in violation of these Terms.
  • Reverse-engineer, decompile, disassemble, or otherwise attempt to derive the source code of the app, except where this restriction is prohibited by law.
  • Interfere with, disrupt, overload, or attempt to gain unauthorized access to the app, our providers, or other users' data.
  • Abuse, probe, or attempt to circumvent the app's security or access controls.
  • Resell, sublicense, or commercially exploit the app without our permission.

4. A planning aid, not professional advice

Nudge is a daily-planning aid. It uses AI to interpret what you say and to help organize your schedule, and AI can make mistakes. The app does not provide medical, legal, financial, or other professional advice. You are responsible for reviewing your schedule and for any decisions you make. Do not rely on the app for anything safety-critical or time-critical without checking it yourself.

5. "As is," no warranty

The app is provided "as is" and "as available," without warranties of any kind, whether express or implied, including any implied warranties of merchantability, fitness for a particular purpose, accuracy, or non-infringement. We do not warrant that the app will be uninterrupted, error-free, or that reminders will always be delivered on time.

6. Limitation of liability

To the fullest extent permitted by law, Nudge will not be liable for any indirect, incidental, special, consequential, or punitive damages, or for any loss of data, missed events, or lost opportunities, arising out of or relating to your use of (or inability to use) the app. To the extent any liability cannot be excluded, it is limited to the amount you paid us for the app in the twelve months before the claim, which may be zero.

7. Termination

You may stop using the app at any time and delete your account and all your data via Profile → Delete account. We may suspend or terminate your access if you violate these Terms or to comply with the law. On termination, your license to use the app ends.

8. Changes to these Terms

We may update these Terms from time to time. When we make a material change, we will update the "Last updated" date below. Your continued use of the app after a change means you accept the updated Terms.

9. Governing law

These Terms are governed by the laws of the State of Washington, United States, without regard to its conflict-of-laws rules.
